Detailed Scope & Process

What Is Professional Tax?

Professional tax is a tax levied by state governments on persons earning income from a profession, trade, calling or employment. It is not a central tax. Each state that levies it has its own Professional Tax Act, which sets out who must register, the slabs of tax, the due dates and the penalties. Article 276 of the Constitution limits the amount of tax that a state may levy on a person in a year. Not all states and union territories impose professional tax, so a business in one state may have no obligation while the same business in another state must register and pay.

For a business, professional tax involves two sets of duties. First, as an employer, it must deduct the tax from employees' salaries and pay it to the state. Second, the business itself, and persons such as professionals, traders and company directors, may have to pay professional tax on their own account. The registrations for these are different, and many businesses discover the second one late.

Types of Professional Tax Registration

  • Professional Tax Registration Certificate (PTRC): for employers who pay salaries and wages. The employer deducts tax from employees according to the state slab and deposits it with the department.
  • Professional Tax Enrolment Certificate (PTEC): for persons and entities who are liable to pay the tax on their own account, such as professionals, traders, firms and companies, as the state law provides.

The names and procedures differ by state. For example, some states use a single registration, some call the certificates by different names, and some collect the tax through a local body. We follow the rules of the state in which you are liable.

Who Needs to Register?

  • Employers with employees in a state that levies professional tax, above the minimum prescribed threshold of salary.
  • Companies, firms, LLPs and other entities carrying on business in such a state, as the state law provides.
  • Professionals such as chartered accountants, company secretaries, doctors, lawyers, architects and consultants, where the state law covers them.
  • Traders, shopkeepers, contractors and agents, as the state law provides.
  • Directors, partners and other persons who draw remuneration from the entity, where the law applies.

An employer that has employees in several states may have to register separately in each state that levies the tax, and a state without professional tax does not require any registration at all.

How Professional Tax Works for an Employer

  • The employer registers and obtains the certificate and a registration number.
  • Each month, it works out the tax payable for each employee according to the salary slab in the state's schedule and deducts it from the salary.
  • It deposits the total with the state, using the state's online portal or challan, by the due date.
  • It files returns, monthly, quarterly or annually, depending on the state and the amount of tax.
  • It maintains records of deduction and payment and issues the tax details in the employees' payslips and Form 16 where relevant.

Non-deduction, late deposit and late filing attract interest and penalty under the state law. Because the employer has deducted the tax from employees' salary, the liability is taken seriously by state departments.

What Our Professional Tax Service Includes

  • Check of where you are liable: the states in which you have employees, offices or business activity, and whether those states levy the tax.
  • Application for PTRC for employers and PTEC for entities and professionals, as the state requires.
  • Preparation of the application on the state portal, with the documents in the required format.
  • Guidance on the slabs, the monthly deduction process and the payroll set-up.
  • Tracking of the application, and response to clarifications raised by the department.
  • Delivery of the registration or enrolment certificate, as issued.
  • A due-date calendar for payment and returns in each state.
  • Optional monthly payment and return filing, where you wish us to manage it.

How the Process Works

We begin by asking where your employees work and what each is paid. We then identify the states and registrations that apply and give you a checklist of documents. After you send the documents, we prepare the application on the state portal and share the details for your confirmation. The department may verify the documents and issue the certificate, sometimes after a physical inspection of the place of work in some states. We give you the certificate and a short note on how to apply the slabs through payroll. The time needed depends on the state and the speed of its department. Where you ask for it, we continue with the monthly payments and returns.

Important Considerations

  • Rates, slabs, thresholds and due dates differ widely between states, and they are revised by the states. Please do not rely on a figure from another state.
  • A business that has no employees may still be liable for itself in some states.
  • Employers should register in time. Back-dated registration can lead to demand for past tax, interest and penalty.
  • Professional tax is a deduction in computing taxable income for the person who pays it, subject to the Income-tax Act. Please consult your chartered accountant on tax treatment.
  • Replying to notices, assessments and appeals under the state law are separate services.

💰 Pricing Considerations

Our professional fee depends on the number of states and registrations involved, the number of employees, whether you need only registration or also monthly payment and return filing, whether payroll slab setup is required, and whether there are past periods to regularise. Government charges are separate. Professional tax itself, any registration or enrolment fee, interest and penalty are set by each state and differ widely, and they are payable by you. DSC charges and other third-party costs are also separate. Replying to notices, assessments and appeals is priced separately. Applicable statutory/government fees may vary based on jurisdiction, entity type and application details. Your professional fee quote is shared before work begins.

❓ Frequently Asked Questions & Local Advisory in Baran

📍 Includes 5 localized questions tailored specifically for Baran businesses

15 Q&As
In Rajasthan, any employer engaging 5 or more employees must register for Professional Tax within 30 days of crossing this threshold. This applies to companies, LLPs, partnership firms, proprietorships, NGOs, schools, hospitals, and any other establishments with paid employees in Baran. Self-employed professionals — doctors, lawyers, CA, architects, and others — must also register for PT individually and pay a fixed amount per year based on the Rajasthan PT Act's schedule for self-employed persons.
Rajasthan's Professional Tax slab for salaried employees (as per the current schedule): Monthly salary up to ₹5,000 — Nil; ₹5,001 to ₹10,000 — Nil; ₹10,001 to ₹15,000 — ₹75 per month; ₹15,001 to ₹20,000 — ₹100 per month; Above ₹20,000 — ₹200 per month (maximum ₹2,400 per year). Note: Rajasthan PT rates are revised by the state government from time to time. We apply the current applicable rates for Baran employer payrolls. Certain categories like persons above 65 years, individuals with disabilities, and others may be exempt.
Professional Tax deducted from employees' salaries must be deposited to the Rajasthan Commercial Tax Department on or before the 15th of the following month. For example, PT deducted in April must be deposited by May 15. Annual PT returns are due by specified dates — typically after the financial year end. Late deposit attracts interest at 18% per annum and a penalty for non-filing. We deposit PT on behalf of Baran employers every month and file the periodic returns.
Professional Tax is a liability of the employee — the employer is required to deduct it from the employee's salary and remit it to the government. The employer cannot pay PT "on behalf" of the employee from company funds without it being treated as a perquisite (taxable benefit) in the employee's hands for income tax. The standard practice in Baran is for the employer to deduct PT from gross salary and show it as a deduction in the salary slip. PT paid by the employer is a fully deductible business expense for income tax.
Yes. We recommend proactive PT registration for rapidly growing startups in Baran. Registration is valid from the date of registration, so registering early avoids any retrospective liability if you cross the 5-employee threshold mid-month. The registration process through the Rajasthan Commercial Tax portal is straightforward, and there is no ongoing compliance burden until you actually start paying salaries above the threshold amounts. Being registered also simplifies payroll setup in your accounting software.
Professional tax is a tax levied by state governments on income from profession, trade, calling or employment. It is governed by each state's Professional Tax Act, and the Constitution limits the amount that can be levied per person in a year. Not every state levies it.
Employees and self-employed persons in states that levy it, with the employer deducting and depositing the tax for employees. Entities, professionals and traders may also be liable on their own account, depending on the state law.
No. Only some states and union territories levy it. A business with employees in a state that does not levy it has no professional tax obligation there. We check the position for each state in which you operate.
PTRC is the registration certificate for employers who deduct and pay the tax for employees. PTEC is the enrolment certificate for persons and entities who pay the tax on their own account. The names and procedures differ by state, and many businesses need both.
You need PAN, constitution documents, identity and address proof of the proprietor, partners or directors, address proof of the place of work with NOC if rented, a list of employees with salaries, and bank details. Some states require a DSC.
The employer works out the tax for each employee as per the salary slab of the state and deducts it from the monthly salary. It deposits the total with the state by the due date and files returns monthly, quarterly or annually as the state requires.
State laws provide for interest on late payment and penalties for non-registration, non-deduction, late deposit and late filing. The rates differ by state. Since the tax is deducted from employees, departments take non-payment seriously.
We estimate 3 to 10 working days from receipt of complete documents. Some states issue certificates online quickly, while others verify or inspect the place of work. The state department's processing time is outside our control.
The tax itself, any registration or enrolment fee, interest and penalty are set by each state and differ widely. We do not quote a single figure here because it varies. We confirm the amounts before you pay, and our professional fee is separate.
Professional tax paid is generally allowed as a deduction in computing taxable income, subject to the Income-tax Act and the person's circumstances. Please consult your chartered accountant for your situation.

Sole Proprietorship Registration in India

Sole proprietorship registration is the quickest way for an individual to start a business in India. There is no separate incorporation under company law, so a proprietorship is established through the registrations your business activity needs, such as GST, Udyam, a Shops and Establishment licence and a current account in the business name. It suits freelancers, traders, shopkeepers, consultants and small service providers who want full control with minimal compliance. StartBizX helps you decide which registrations apply, prepares the applications and keeps your documents consistent. Approvals depend on the relevant authorities, fees vary by state and activity, and the owner's liability remains unlimited.
