Trademark Search in India: Availability and Conflict Check

A trademark search checks whether a name, logo or slogan is already registered, pending or in use by someone else for similar goods or services, before you file, print packaging or launch. It looks at identical and phonetically or visually similar marks, the classes and goods covered, the status of earlier marks and, where you ask, business names, domains and marketplaces. StartBizX runs the search, reviews the findings and gives a written report with a risk assessment and a recommendation on whether to proceed, modify the mark or choose another. A search reduces risk and cannot guarantee registration or prevent later challenges, and the Registry decides on the application. Government fees apply only to an official Registry search. This page explains the types of search, documents and process.

Detailed Scope & Process

What Is a Trademark Search?

A trademark search is an investigation into whether a name, logo or slogan that you want to use is already in use or already registered by someone else for similar goods or services. It is the step that should come before filing a trademark application, before printing packaging, before launching a website or before buying a domain name. Its purpose is to estimate the risk that your mark will be refused by the Trade Marks Registry, opposed by another owner, or later challenged for infringement or passing off.

Many trademark problems are discovered after the money has been spent: a logo is printed on thousands of packages, a domain name is registered, a marketplace listing goes live, and then a notice arrives or the Registry cites an earlier mark. A search costs far less than a rebrand, and it is one of the most useful pieces of advice a new business can get.

What Does a Trademark Search Look At?

  • Identical marks: marks that are the same as yours, in the same or related classes.
  • Similar marks: marks that look alike, sound alike (phonetic similarity), have the same meaning or give the same overall impression, since the test under the Trade Marks Act, 1999 is deceptive similarity and not only identity.
  • Logo and device marks: a visual comparison of logos and symbols, using classification codes for design elements.
  • Class and goods: whether the earlier marks cover goods or services that are the same as or similar to yours, since a similar mark in an unrelated class may not matter.
  • Status of earlier marks: whether they are registered, pending, objected, opposed, abandoned or removed, because only live rights matter.
  • Applicant and use: who owns the earlier mark, since the same owner or a connected owner may be a different case.
  • Common law use: unregistered use in the market, such as business names, domain names, social media handles and marketplace listings, because an unregistered mark can still support a passing off action.

A search of the Registry records is only one part. A mark that does not appear on the register may still be in use by a business with a reputation, and a thorough search looks beyond the register.

Types of Search

  • Quick availability search: a basic search of the Registry's public database, giving an early view on identical and obviously similar marks.
  • Comprehensive search: a wider search covering phonetic variations, translations and transliterations, multiple classes and related goods, together with a market and domain check.
  • Logo or device search: a visual search by design codes and image comparison.
  • Official search with the Registry: a formal search request under the Rules, for which the Registry issues a certificate, available on payment of a fee.

No search can be fully exhaustive, because applications filed recently may not yet be visible, and the Registry's examiner can take a different view. A search reduces risk and does not remove it.

Who Should Run a Trademark Search?

  • Founders choosing a business, brand or product name.
  • Businesses about to file a trademark application.
  • Companies planning to rebrand or to launch a new product line.
  • E-commerce sellers who are about to list products under a new brand.
  • Businesses that have received a notice or an objection and want to understand where they stand.
  • Buyers of a business or brand who want to check the target's marks in due diligence.

What Our Trademark Search Service Includes

  • A discussion of the mark, the goods and services, the markets and the plans.
  • A search of the Registry's records for identical and similar word and logo marks in the relevant classes.
  • Variants searched: spelling changes, phonetic equivalents, translations and combined forms.
  • A check of the status of each relevant earlier mark, and the owner and the goods covered.
  • A check of the business names, domains, social handles and marketplaces, where you ask for it.
  • A written report that lists the relevant marks, assesses the level of risk and recommends whether to proceed, modify the mark or choose another.
  • Advice on classes and on the scope of the application if you proceed.
  • A short discussion of the report with you.

How the Process Works

You send us the mark, the logo if any, and a description of what you sell or intend to sell. We run the search, review the results and prepare a report that sets out the findings in plain language. We then discuss the report with you, and if you choose to proceed we can prepare the trademark application. A basic search is usually completed in a day or two, and a comprehensive search takes a little longer. The report states the date up to which the Registry data was searched, because the position can change as new applications appear.

Important Considerations

  • A search report is an assessment of risk, not a legal guarantee that a mark will be registered or will not be challenged. The Registry and the courts decide on the facts and the law.
  • A clear search today does not protect you from an application filed by someone else tomorrow. Filing early matters.
  • Searches reflect the information available on the Registry's public records at the time and may not include very recent filings.
  • Where a conflict is found, there may be options such as modifying the mark, narrowing the goods, obtaining consent or choosing another mark. We discuss them with you.
  • A detailed opinion on infringement or legal proceedings is separate and is best handled by an advocate.

💰 Pricing Considerations

Our professional fee depends on the type of search, the number of marks and classes, whether a logo or device search is included, whether business name, domain and marketplace checks are added, and the urgency. A quick availability search costs less than a comprehensive search with a risk report. Government fees are separate. The Registry's online public search is generally available without charge, while an official search request to the Registry carries a fee set under the Rules. Costs for third-party databases and other items are separate. If you proceed to filing, the application is priced separately. Applicable statutory/government fees may vary based on jurisdiction, entity type and application details. Your professional fee quote is shared before work begins.

⚠️

Common Mistakes to Avoid

  • ⚠ Filing an application without a search
  • ⚠ Relying only on an identical-match search and missing similar marks
  • ⚠ Ignoring phonetic and translation similarity
  • ⚠ Searching only one class when related classes also matter
  • ⚠ Not checking the status of earlier marks, such as pending or opposed ones
  • ⚠ Ignoring unregistered use, business names and domain names
  • ⚠ Treating a clear search as a guarantee of registration
  • ⚠ Waiting after the search while someone else files a similar mark
  • ⚠ Printing packaging or launching before the search is done
  • ⚠ Using a search done long ago, since new applications keep appearing
  • ⚠ Searching for the name and not the logo
  • ⚠ Not recording the date up to which the search was done

❓ Frequently Asked Questions

10 Q&As
A trademark search checks whether a name, logo or slogan is already registered, pending or in use by someone else for similar goods or services. It is done before filing a trademark application or launching a brand, to assess the risk of refusal, opposition or infringement claims.
It is not a legal requirement, but it is strongly recommended. Filing without a search risks an objection, an opposition or a later dispute, and it can waste the application fee and the branding spend.
It covers identical and similar marks, including phonetic, visual and meaning-based similarity, the classes and goods covered, the status and owner of earlier marks and, where you ask, business names, domains, social handles and marketplaces.
Yes. The Registry's public search is available online. Interpreting the results, especially for phonetic and visual similarity and for classes, takes experience, which is where a professional report helps.
No. A search is an assessment of risk and not a guarantee. The Registry's examiner can take a different view, a new application may have been filed recently, and the mark may face an opposition.
It is a formal request to the Registry under the Rules for a search and a certificate, available on payment of a fee. It is different from the public search and from our search report, and we can guide you on whether it is useful.
We need the name or logo, a description of the goods and services, the classes if known, the markets, and whether the mark is already in use. If you plan to file, we also need the applicant's details.
We estimate 1 to 3 working days. A quick check takes less time, and a comprehensive search with a market check takes longer. The report states the date up to which the Registry data was searched.
The Registry's online public search is generally available without charge. An official search request carries a fee under the Rules. We do not quote a single figure here because it varies, and our professional fee is separate.
Options include modifying the mark, narrowing the goods or services, choosing another mark, seeking consent from the owner or, in suitable cases, proceeding and preparing for an objection. We discuss the options and the risk with you.

Brand Protection: IP Audit, Watch Services and Enforcement

Brand protection is the ongoing work of securing your brand's legal rights, watching for misuse and acting when someone infringes them. It goes beyond a one-time trademark filing to cover an IP audit, trademark watch on the Journal, monitoring of marketplaces, domains and social media, cease-and-desist notices, takedown requests, domain complaints, customs recordal and brand use agreements. StartBizX builds a plan around your brand and channels, sets up monitoring, gathers evidence and recommends the right step for each case, with advocates for court action. Design Registration in India: Protect Your Product's Appearance

Design registration protects the visual appearance of a manufactured article, namely its shape, configuration, pattern, ornament or composition of lines or colours, under the Designs Act, 2000. It suits products that compete on looks, such as furniture, packaging, jewellery, footwear, electronics and textiles. The design must be new and must not be disclosed before filing. StartBizX assesses your design, searches for similar designs, guides the preparation of the views and statement of novelty, files Form 1 with the Designs Wing, replies to objections and sets renewal reminders. A registered design is valid for ten years and extendable by five. Registration is granted by the Design Office and cannot be guaranteed.

Trademark Objection Reply: Examination Report and Hearing Support

A trademark objection is raised in the Trade Marks Registry's examination report when an examiner finds a problem under the Trade Marks Act, 1999, such as lack of distinctiveness, descriptiveness or similarity to an earlier mark. It does not mean the application has failed, but a reply has to be filed within the time allowed or the application can be treated as abandoned. StartBizX reviews the report, prepares a strategy, collects evidence of use, drafts and files the reply and supports you at the hearing, where included. The decision rests with the Registrar and acceptance cannot be guaranteed. Government fees for the reply are minimal or nil, and appeals are separate. This page explains the grounds, documents, outcomes and process.
